Agreement. By purchasing, receiving, redeeming, or using any digital product/service from The Day Before Servers, the customer confirms that they have read, understood, and accepted these Terms of Service and the Refund Policy.
Product description and access. Digital products/services provided by The Day Before Servers are exclusively for use within The Day Before Servers community DayZ servers. Access is normally granted immediately after successful payment unless stated otherwise.
Digital license only. Purchases grant a limited, revocable, non-exclusive, non-transferable license to use the purchased digital benefit inside The Day Before Servers community only. No ownership interest, property right, or cash value is transferred.
Exclusive use clause. Purchased products/services are usable solely within The Day Before Servers community DayZ servers and are not transferable to other games, platforms, communities, accounts, or servers unless The Day Before Servers explicitly allows it in writing.
Eligibility and account responsibility. The customer confirms that they are authorized to use the selected payment method and that the linked game, Steam, Discord, and store accounts are correct. The Day Before Servers is not responsible for purchases made to the wrong account due to customer error.
Immediate performance and withdrawal acknowledgement. The customer expressly consents to immediate delivery/performance of digital content/services and acknowledges that, once delivery begins, any statutory withdrawal right is lost to the extent permitted by German/EU law.
Community rules and revocation. Products/services are conditional on compliance with The Day Before Servers rules, community guidelines, and staff instructions. The Day Before Servers may suspend, modify, or revoke access without refund in cases of misuse, cheating, exploitation, harassment, rule violations, chargebacks, payment reversals, fraud, or breach of these terms.
Server availability and changes. The Day Before Servers may update, rebalance, replace, remove, rename, wipe, suspend, or discontinue servers, features, packages, perks, items, queues, roles, or services for technical, gameplay, operational, legal, or community reasons. Availability is not guaranteed.
Intellectual property. The website content, layout, design, data, databases, graphics, text, branding, configuration, and related materials are protected by intellectual property laws and belong to The Day Before Servers or their respective rights holders. Reproduction or unauthorized use without written consent is prohibited.
Payment disputes. Customers agree to contact The Day Before Servers support before opening a chargeback, reversal, or payment dispute. If a chargeback, reversal, or dispute occurs, The Day Before Servers may automatically revoke the related benefits, remove credits, restrict access, and preserve transaction, account, delivery, and acceptance logs as evidence.
Liability limitation. To the maximum extent permitted by law, The Day Before Servers is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss caused by server downtime, wipes, updates, bans, lost access, or inability to use digital products/services. Nothing in these terms limits liability where limitation is prohibited by mandatory law, including intent, gross negligence, or injury to life, body, or health.
Amendments. The Day Before Servers may amend these terms at any time. Continued use of the website, servers, or purchased digital products/services after changes are published constitutes acceptance of the amended terms.
Governing law and jurisdiction. These terms are governed by the laws of Germany. Disputes are subject to the courts of Germany to the extent permitted by applicable mandatory consumer law.
